Acceptance of Terms
By downloading, installing, viewing, or using any support tool or material provided by K-VIA Professional Engineer Office (“we,” “our,” or “us”) (including applications, Excel add-ins, web applications, written works, and documents; the “Materials”), or by using our website, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms apply to all Materials published under the K-VIA P.E. Office brand, as well as the website at https://k-via.jp. For consulting services, the individual agreement takes precedence over these Terms.
Description of Services
K-VIA P.E. Office primarily provides professional and technical consulting services. As support for that work, we also develop applications, write, and provide the results as Materials. The Materials may include calculation tools, logging functions, reference materials, explanatory articles, and related utilities.
We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
User Obligations
By using our services, you agree to:
- Use the Materials only for lawful purposes and in accordance with these Terms
- Not reproduce, repost, modify, redistribute, sell, or exploit all or any part of the Materials without our express written permission
- Where the Materials are software, not attempt to reverse engineer, decompile, or disassemble them
- Not use our services in any way that could damage, disable, or impair the functionality of the Materials
Intellectual Property
All content, text, design, code, and materials within the Materials and our website are the intellectual property of K-VIA Professional Engineer Office, unless otherwise stated. All rights are reserved. Quotation within the scope permitted by copyright law is not restricted.
You may not use our name, logo, or brand materials without prior written consent.
Purchases
Some features or content may require payment. All purchases are processed through platform operators and are subject to their respective terms and refund policies.
- Prices are displayed in your local currency at the time of purchase
- Subscriptions renew automatically unless cancelled before the renewal date
- Some content may be available as a one-time purchase (permanent license). One-time purchases are a permanent license for the version at the time of purchase
- Where the Materials are software, we endeavor to provide version updates compatible with OS updates, but compatibility cannot be guaranteed in all cases for technical reasons. Refunds in such cases are subject to the relevant platform operator’s refund policy
- Where the Materials are software, previously purchased content can be restored using the “Restore Purchases” function in the settings of the Materials
We do not process payments directly and do not have access to your payment information.
Disclaimer of Calculation Results
Calculation results and other information provided by the Materials are statistical estimates or general information. They do not guarantee product quality, safety, or regulatory compliance.
Final decisions must always be made by a qualified person in charge. Damages arising from reliance on calculation results or other information are governed by Section 08.
Disclaimer of Warranties
To the extent permitted by applicable law, the Materials and the website are provided “as is” and “as available” without any warranties of any kind, either express or implied.
We do not warrant that:
- The Materials will be error-free or uninterrupted, or will operate or be available without interruption
- Calculation results and other content are free from errors, up to date, or suitable for any specific professional purpose
- The Materials will meet your specific requirements
Product information retrieved from external product databases is provided “as is.” We do not guarantee the accuracy, completeness, or timeliness of such third-party data.
Important: The Materials are intended as reference and support only. Their content does not constitute advice, appraisal, or certification by a Professional Engineer or any other professional. All results and outputs must be independently verified by a qualified professional before use in any professional, legal, or safety-critical context. Consulting services are provided under an individual agreement, which takes precedence over these Terms.
Limitation of Liability
To the extent permitted by applicable law, K-VIA Professional Engineer Office shall not be liable for any indirect, special, incidental, or consequential damages, or for any loss of profits, arising from your use of, or inability to use, the Materials or the website.
This includes, but is not limited to, damages resulting from reliance on calculation results or other content, data loss, or errors in the Materials. Please back up your data yourself.
The preceding paragraphs do not apply where the damage results from our willful misconduct or gross negligence, or where applicable law does not permit the limitation of liability.
Privacy
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the “Last Updated” date at the top of this page. Continued use of our services after changes are posted constitutes your acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Japan.
利用規約への同意
K-VIA技術士事務所（K-VIA Professional Engineer Office、以下「当事務所」）が提供するサポートツールおよび制作物（アプリケーション、Excelアドオン、Webアプリケーション、執筆物・資料など。以下「本制作物」）をダウンロード、インストール、閲覧もしくは使用し、またはウェブサイトを利用することにより、お客様は本利用規約に同意したものとみなします。同意いただけない場合は、当事務所のサービスをご利用いただけません。
本規約は、K-VIA P.E. Office ブランドで公開されるすべての本制作物、およびウェブサイト https://k-via.jp に適用されます。コンサルティングサービスについては、個別の契約が本規約に優先します。
サービスの内容
K-VIA P.E. Officeは、主に専門的・技術的なコンサルティングサービスを提供しています。また、そのサポートとして、アプリケーションの開発や執筆などを行い、本制作物として提供しています。本制作物には、計算ツール、ログ機能、参考資料、解説記事およびその関連ユーティリティが含まれる場合があります。
当事務所は、事前の通知なしにいつでもサービスの変更、停止、または終了を行う権利を留保します。
利用者の義務
当事務所のサービスを利用することにより、お客様は以下に同意するものとします。
- 本規約および適用法令に従い、合法的な目的のみに本制作物を使用すること
- 当事務所の書面による明示的な許可なく、本制作物の全部または一部を複製、転載、改変、再配布、販売、または利用しないこと
- 本制作物がソフトウェアである場合、リバースエンジニアリング、逆コンパイル、または逆アセンブルを試みないこと
- 本制作物の機能を損なう可能性のある方法でサービスを使用しないこと
知的財産権
本制作物およびウェブサイトに含まれるすべてのコンテンツ、文章、デザイン、コード、および素材は、別段の記載がない限り、K-VIA技術士事務所の知的財産です。すべての権利は留保されています。ただし、著作権法の範囲での引用は妨げません。
当事務所の名称、ロゴ、またはブランド素材は、事前の書面による同意なく使用することはできません。
購入について
一部の機能やコンテンツは有料となる場合があります。すべての購入はプラットフォーム事業者を通じて処理され、各社の利用規約および返金ポリシーが適用されます。
- 価格は購入時にお客様の現地通貨で表示されます
- サブスクリプションは、更新日前にキャンセルされない限り自動的に更新されます
- 一部のコンテンツは買い切り型（永続ライセンス）でご購入いただける場合があります。買い切り購入は購入時点のバージョンに対する永続ライセンスです
- 本制作物がソフトウェアの場合、当事務所はOSのアップデートに対応したバージョンアップに努めますが、技術的な理由により互換性が保てない場合があります。その場合の返金は各プラットフォーム事業者の返金ポリシーに準じます
- 本制作物がソフトウェアの場合、購入済みのコンテンツは、本制作物の設定内の「購入を復元」機能で復元できます
当事務所は直接決済処理を行わず、お客様の支払情報にアクセスすることはありません。
計算結果の免責事項
本制作物が提供する計算結果その他の情報は、統計的推定値または一般的な情報であり、製品品質・安全性・法令適合性を保証するものではありません。
最終的な判断は必ず担当者が行ってください。計算結果その他の情報への依拠により生じた損害については、第8条に従います。
免責事項
適用法令が許容する範囲で、本制作物およびウェブサイトは、明示・黙示を問わず、いかなる保証もなく「現状のまま」提供されます。
当事務所は以下について保証しません。
- 本制作物がエラーなく、または中断なく動作・利用できること
- 計算結果その他の内容が、誤りを含まないこと、最新であること、または特定の専門的目的に適合すること
- 本制作物がお客様の特定の要件を満たすこと
外部の商品データベースから取得する商品情報は「現状のまま」提供されます。当事務所は、当該第三者データの正確性、完全性、または最新性を保証しません。
重要：本制作物は、あくまで参考・補助として提供されています。その内容は、技術士その他の専門家による助言・鑑定・認証を構成するものではありません。専門的、法的、または安全上重要な場面で使用する前には、必ず有資格の専門家による独自の検証を行ってください。コンサルティングサービスは、個別の契約に基づき提供し、その契約が本規約に優先します。
責任の制限
適用法令が許容する範囲で、K-VIA技術士事務所は、本制作物およびウェブサイトの使用または使用不能から生じる、間接損害、特別損害、偶発的損害、結果的損害および逸失利益について、責任を負いません。
これには、計算結果その他の内容への依存、データの損失、または本制作物のエラーに起因する損害が含まれますが、これに限りません。データのバックアップは、お客様ご自身で行ってください。
前各項は、当事務所の故意または重大な過失による場合、および法令により責任の制限が認められない場合には適用しません。
本規約の変更
当事務所は、本規約をいつでも変更する権利を留保します。変更があった場合は、ページ上部の「最終更新日」を更新します。変更後もサービスをご利用いただいた場合、改訂された規約に同意したものとみなします。
準拠法
本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関して生じた紛争は、日本の裁判所を専属的合意管轄裁判所とします。
